By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

By creating an account or using MediaGuard, you confirm that you:

• Will comply with all applicable laws and regulations

2. Description of Services

MediaGuard provides AI-powered deepfake detection and content verification services, including:

• Content registration and verification
• Identity fingerprinting using biometric data
• Deepfake detection and analysis
• Authenticity certificates and verification links
• Content protection and monitoring

3. User Accounts

3.1 Account Creation

You must create an account to access certain features. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and up-to-date

3.2 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activities
• Abuse or misuse our Services
• Fail to pay applicable fees

4. Acceptable Use

4.1 Permitted Use

You may use our Services to:

• Register and verify your authentic content
• Protect your digital identity and reputation
• Detect deepfakes and manipulated media
• Generate authenticity certificates

4.2 Prohibited Use

You may NOT use our Services to:

• Upload content you do not own or have rights to
• Violate any laws, regulations, or third-party rights
• Harass, abuse, or harm others
• Distribute malware, viruses, or harmful code
• Attempt to circumvent security measures
• Reverse engineer or copy our technology
• Use automated systems to access our Services without permission
• Impersonate others or misrepresent your identity

5. Content Ownership and Rights

5.1 Your Content

You retain all ownership rights to content you upload ("Your Content"). By uploading content, you grant MediaGuard a limited, worldwide, non-exclusive license to:

• Store, process, and analyze Your Content
• Generate hash signatures and verification data
• Display verification results to authorized parties
• Improve our AI models and services (in anonymized form)

5.2 Our Content

All intellectual property rights in the Services, including software, algorithms, designs, and trademarks, are owned by MediaGuard Pvt Ltd. You may not copy, modify, or distribute our content without permission.

6. Subscription and Payments

6.1 Subscription Plans

We offer Free, Pro, and Studio subscription plans. Paid plans are billed monthly and automatically renew unless cancelled.

6.2 Payment Terms

• All fees are in INR (Indian Rupees) unless otherwise stated
• Payments are processed securely through Razorpay
• You authorize us to charge your payment method for recurring subscriptions
• Fees are non-refundable except as required by law

6.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

7. Biometric Data and Privacy

By using our identity fingerprinting features, you consent to our collection and processing of biometric data (face and voice patterns) as described in our Privacy Policy. This data is:

• Encrypted and stored securely
• Used solely for identity verification purposes
• Not shared with third parties without your consent
• Deletable upon request

8. Disclaimers and Limitations

8.1 Service Availability

We strive to provide reliable services but do not guarantee uninterrupted access. Services may be unavailable due to maintenance, updates, or technical issues.

8.2 Accuracy

While our AI technology is highly accurate, we cannot guarantee 100% detection of all deepfakes or manipulated content. Verification results should be used as guidance, not absolute proof.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDIAGUARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

9. Indemnification

You agree to indemnify and hold harmless MediaGuard Pvt Ltd, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content

10. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes shall be resolved through:

• Good faith negotiation
• Mediation (if negotiation fails)
• Arbitration in Delhi, India (if mediation fails)
• Courts of Delhi, India (as a last resort)

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Services. Continued use after changes constitutes acceptance of the new Terms.
